Creators/executive producers Miles Miller and Alfred Gough and series co-producer Tollin/Robbins Prods. sued Warner Bros. TV, the studio behind Smallville, and The CW network:

Causes of action for breach of contract and breach of fiduciary duty are alleged against Time Warner and its divisions — WBTV, Warner Bros. Domestic TV Distribution, the now-defunct WB network, where the show started — and the CW, a co-venture with CBS. The complaint says WBTV made license fee deals with the WB and then the CW that “were not arms-length.”

Millar and Gough are right. But I doubt Warner would pay the bill. Smallville is getting less (very much less) advertisement in France. I’ve heard season 8 DVD has been released in march 13th, I haven’t seen anything. That stinks!

Hey Elodie,

Yeah, horrible for Millar & Gough, but really disappointing to read that the WB and The CW licensed the show well-below it’s market value. It’s obviously not a good thing for the show because it means lower gross revenues for Smallville.

I wonder what took them so long though to do something about it…I mean, the show is going on it’s tenth year.
